Midnite Mine Superfund Litigation

HRA prepared an expert witness report and provided testimony at trial for a case involving cost recovery for cleanup of a former uranium mine. HRA conducted research in corporate and federal government records. Research topics included the corporate relationship between the mining company and its parent company, environmental management at the mine, and the United States’ role in overseeing the mining lease, which was on Indian land.

The Environmental Protection Agency had sought to recover full cleanup costs from HRA’s client, the parent company. HRA’s research and testimony contributed to a partial victory for the client, with the judge assigning one-third of the liability to the parent and one-third each to the subsidiary and the United States.
